1. Introduction
This Privacy Policy explains how BasicPlate, LLC, a California limited liability company ("BasicPlate", "we", "us," or "our"), collects, uses, discloses, and protects information when you use the BasicPlate mobile application and related services (the "Service").
By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Service. This Policy is incorporated into our Terms of Use.
The Service is intended for users located in the United States and is designed for individuals 18 years of age or older.
2. Information We Collect
We collect the following categories of information:
Information you provide to us:
- Account information — such as your name (or display name), email address, and, if you sign in through a third-party provider like Sign in with Apple, the identifier that provider shares with us.
- Profile and goal information — optional details you choose to enter, such as your age, sex, height, weight, activity level, and nutrition or weight goals.
- Meal and food data ("Meal Content") — the photos and/or images of meals you capture or upload, and any text descriptions, notes, portion details, or corrections you enter when logging food.
- Communications — information you provide when you contact us for support or otherwise, such as the contents of your messages.
Information generated through your use of the Service:
- Nutrition and log data — the AI-generated calorie, macronutrient, and nutritional estimates associated with your Meal Content, and your food logs, history, and progress over time.
- Usage and analytics data — information about how you interact with the Service, such as features used, session activity, and diagnostic and crash data.
- Device and technical data — such as device model, operating system version, app version, language settings, and a mobile or device identifier.
Information from third parties:
- Subscription and purchase status from Apple — because subscriptions are billed through the Apple App Store, Apple provides us with confirmation of your subscription status and transaction identifiers. We do not receive or store your full payment card number.
Health-related information:
- Some of the information we collect — including your Meal Content, profile details (such as weight or health goals), and nutrition logs — may be considered health-related or sensitive personal information. We treat this information with care and use it only as described in this Policy.
3. How We Use Your Information
We use the information we collect to:
- Provide, operate, and maintain the Service, including creating and managing your account;
- Analyze the meals you log and generate AI-based nutritional estimates;
- Track and display your logs, goals, history, and progress;
- Process and manage your subscription and free trial (through Apple);
- Provide customer support and respond to your requests;
- Monitor, secure, troubleshoot, and improve the Service, including diagnosing technical problems and analyzing usage trends;
- Detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms; and
- Comply with legal obligations and enforce our agreements.
4. How Your Meal Content Is Processed by AI
When you log a meal, the photo and/or text description you provide is transmitted to our third-party AI provider to generate nutritional estimates. We want to be clear about how this works:
- Your Meal Content is sent to the AI provider solely to analyze it and return nutritional estimates to you.
- Our AI provider processes this content on our behalf as a service provider, under contractual terms that restrict its use of your data to providing the service to us.
- Your Meal Content is not used by our AI provider to train or improve its AI models.
- The AI provider is not permitted to use your Meal Content for its own independent purposes.
We use a reputable third-party AI provider to perform this analysis. We may change providers over time and will update this Policy as needed.
5. How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose information only as follows:
- Service providers / sub-processors. We share information with vendors who perform services for us and process data on our behalf under contract, such as:
- our third-party AI provider (to generate nutritional estimates, as described in Section 4 (How Your Meal Content Is Processed by AI));
- our cloud hosting and storage provider (to store account and log data);
- analytics and crash-reporting providers (to help us understand usage and fix problems); and
- customer-support tools (to respond to your requests).
- Apple. Subscription billing is handled by Apple. Your interactions with the App Store are governed by Apple's privacy policy.
- Legal and safety. We may disclose information if required by law, subpoena, or legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, or to investigate fraud or respond to a government request.
- Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction.
- With your consent. We may share information for other purposes with your consent or at your direction.
6. Third-Party Services
The Service relies on third-party services, each of which has its own privacy practices. These may include:
- Apple App Store — app distribution and subscription billing (apple.com/legal/privacy)
- Third-party AI provider — nutritional analysis of Meal Content
- Supabase — data storage and backend (supabase.com/privacy)
- Apple app analytics and diagnostics — usage analytics and crash reporting
We encourage you to review the privacy policies of these third parties. We are not responsible for their practices.
7. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Service, and thereafter as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Meal Content and logs are retained so you can access your history; you can delete individual entries within the App. When you delete your account, we will delete or de-identify your personal information within a reasonable period, except where we are required or permitted to retain it by law.
8. Data Security
We use reasonable administrative, technical, and organizational measures designed to protect your information, such as encryption in transit and access controls. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
9. Your Choices and Rights
You have choices about your information:
- Access and update — You can view and update much of your account and profile information within the App.
- Delete — You can delete individual logs, and you can delete your account (which deletes associated personal information as described in Section 7 (Data Retention)). To delete your account, use the in-app option or contact us at support@basicplate.com.
- Permissions — You can control the App's access to your camera and photos through your device settings. Disabling the camera or photo permission may limit meal-logging features.
- Analytics/tracking — See Section 11 (Analytics and App Tracking) regarding app tracking and analytics choices.
- Communications — You can opt out of non-essential emails by following the unsubscribe instructions in them.
10. Your California Privacy Rights (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), provides you with specific rights regarding your personal information.
- Categories of personal information we collect. In the past 12 months, we have collected the categories described in Section 2 (Information We Collect), which map to the following CCPA categories: identifiers (e.g., name, email, device identifier); customer records; internet or network activity (usage data); and sensitive personal information (health-related information, such as your Meal Content and nutrition/health profile data). We collect this information from you and, for subscription status, from Apple. We use it for the business purposes described in Section 3 (How We Use Your Information).
- No sale or sharing. We do not sell your personal information and do not share it for cross-context behavioral advertising, as those terms are defined under the CCPA/CPRA. We have not done so in the preceding 12 months.
- Sensitive personal information. We use sensitive personal information only for purposes permitted under the CCPA/CPRA, such as providing the Service you request, and not for the purpose of inferring characteristics about you. You may have the right to limit certain uses of sensitive personal information; we already limit our use as described here.
- Your rights. Subject to certain exceptions, you have the right to:
- Know what personal information we collect, use, and disclose;
- Access a copy of the personal information we hold about you;
- Correct inaccurate personal information;
- Delete your personal information;
- Limit the use and disclosure of sensitive personal information; and
- Not be discriminated against for exercising your rights.
- How to exercise your rights. Submit a request by emailing support@basicplate.com. We will verify your request (for example, by confirming control of your account email) before fulfilling it. You may use an authorized agent to make a request on your behalf, subject to verification. We will respond within the timeframes required by law.
- California "Shine the Light." California residents may request information about our disclosure of personal information to third parties for their direct-marketing purposes. We do not disclose personal information to third parties for their own direct marketing.
11. Analytics and App Tracking
We use analytics and diagnostic tools, such as Apple's app analytics and crash reporting, to understand how the Service is used and to improve it. This information is used primarily in aggregated form to measure performance and fix problems.
We do not currently track your activity across other companies' apps and websites, and we do not use your information for third-party advertising. If this changes in the future, we will request your permission through Apple's App Tracking Transparency prompt before any such tracking occurs. You can review and change tracking permissions at any time in your device's Settings → Privacy & Security → Tracking.
12. Children's Privacy
The Service is not directed to children, and it is intended only for individuals 18 years of age and older. We do not knowingly collect personal information from anyone under 18. In particular, we do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA). If you believe a child has provided us with personal information, please contact us at support@basicplate.com, and we will take steps to delete it.
13. Data Storage and Location
We store and process information in the United States. If you access the Service from outside the United States, you understand that your information will be processed in the United States, where privacy laws may differ from those in your location.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will take reasonable steps to notify you, such as by posting the updated Policy in the App or on our website and updating the "Last updated" date above. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Policy.
