This Privacy Policy explains how BasicPlate, LLC, a California limited liability company ("BasicPlate", "we", "us," or "our"), collects, uses, discloses, and protects information when you use the BasicPlate mobile application and related services (the "Service").
By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Service. This Policy is incorporated into our Terms of Use.
The Service is intended for users located in the United States and is designed for individuals 16 years of age or older. If you are 16 or 17 years old, you may use the Service only with the consent of a parent or legal guardian, and we apply additional protections to your information. See Section 12 (Children's and Minors' Privacy).

We retain personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, as described below, and thereafter as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
We may retain information for a longer period where we are required or permitted to do so by law, or where necessary to establish, exercise, or defend legal claims.
We use reasonable administrative, technical, and organizational measures designed to protect your information, such as encryption in transit and access controls. Age-category and parental-consent information received from app stores is transmitted using industry-standard encryption and used only for compliance purposes. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
You have choices about your information:
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), provides you with specific rights regarding your personal information.
Categories of personal information we collect. In the past 12 months, we have collected the categories described in Section 2 (Information We Collect), which map to the following CCPA categories: identifiers (e.g., name, email, device identifier); customer records; internet or network activity (usage data); and sensitive personal information (health-related information, such as your Meal Content and nutrition/health profile data). We collect this information from you and, for subscription status and age category, from Apple and other app stores. We use it for the business purposes described in Section 3 (How We Use Your Information).
No sale or sharing. We do not sell your personal information and do not share it for cross-context behavioral advertising, as those terms are defined under the CCPA/CPRA. We have not done so in the preceding 12 months.
Minors. We do not sell or share the personal information of consumers under 16 years of age, and we have not done so in the preceding 12 months. Because we do not sell or share personal information at all, the CCPA/CPRA affirmative opt-in requirements applicable to consumers under 16 are not triggered. A parent or legal guardian may exercise CCPA/CPRA rights on behalf of a user aged 16 or 17.
Sensitive personal information. We use sensitive personal information only for purposes permitted under the CCPA/CPRA, such as providing the Service you request, and not for the purpose of inferring characteristics about you. You may have the right to limit certain uses of sensitive personal information; we already limit our use as described here.
Your rights. Subject to certain exceptions, you have the right to:
How to exercise your rights. Submit a request by emailing support@basicplate.com. We will verify your request (for example, by confirming control of your account email) before fulfilling it. You may use an authorized agent to make a request on your behalf, subject to verification. We will respond within the timeframes required by law.
California "Shine the Light." California residents may request information about our disclosure of personal information to third parties for their direct-marketing purposes. We do not disclose personal information to third parties for their own direct marketing.
We use analytics and diagnostic tools, such as Apple's app analytics and crash reporting, to understand how the Service is used and to improve it. This information is used primarily in aggregated form to measure performance and fix problems.
We do not currently track your activity across other companies' apps and websites, and we do not use your information for third-party advertising. If this changes in the future, we will request your permission through Apple's App Tracking Transparency prompt before any such tracking occurs. You can review and change tracking permissions at any time in your device's Settings → Privacy & Security → Tracking.
Users under 18. We do not use the personal information of users we know or reasonably believe to be under 18 for targeted advertising or cross-context behavioral advertising, and we do not sell it. We do not request App Tracking Transparency permission from users we know to be under 18, and we will not track such users across other companies' apps and websites. Where we offer privacy-related settings, we configure them to the most protective option available by default for users under 18.
The Service is intended for individuals 16 years of age and older. It is not directed to children under 16, and we do not knowingly collect personal information from anyone under 16.
Children under 13 (COPPA). The Service is not directed to children as that term is defined by the Children's Online Privacy Protection Act (COPPA), and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly.
Users under 16. If we learn or reasonably believe that a user is under 16, we will close the account and delete or de-identify the associated personal information within a reasonable period.
Users aged 16 and 17. Users aged 16 or 17 may use the Service only with the consent of a parent or legal guardian, as described in our Terms of Use. For users we know or reasonably believe to be under 18, we:
Reporting a concern. If you believe that a child under 16 has provided us with personal information, or if you are a parent or legal guardian with questions about your child's account, please contact us at support@basicplate.com and we will take appropriate steps, including deleting the information where required.
We store and process information in the United States. If you access the Service from outside the United States, you understand that your information will be processed in the United States, where privacy laws may differ from those in your location.
We may update this Privacy Policy from time to time. If we make material changes, we will take reasonable steps to notify you, such as by posting the updated Policy in the App or on our website and updating the "Last updated" date above, and we will notify the applicable app stores of the change where required by law. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Policy.
